TERMS OF USE OF THE WEBSITE

Access to THE WEBSITE grants the status of USER and implies full and unconditional acceptance of all terms and conditions set forth in this LEGAL NOTICE.

These conditions govern both the provision of information and any commercial relationships arising between QPV and the users of THE WEBSITE.

If the USER decides to use any of the services managed through THE WEBSITE, they must expressly and previously accept all terms and conditions contained in this LEGAL NOTICE and in the PRIVACY POLICY and COOKIE POLICY. Therefore, if the USER does not agree with each and every one of these conditions, they must refrain from using THE WEBSITE.

Certain provisions of this LEGAL NOTICE refer to the use of specific services and apply exclusively to the relationship between QPV and the USERS of such services, without affecting other USERS of THE WEBSITE unless they subscribe to or use those services.

QPV may modify or update all or part of this LEGAL NOTICE in accordance with changes in applicable legislation and regulations. QPV LIABILITY

QPV shall be liable for damages suffered by the USER as a result of using THE WEBSITE only when such damages are directly attributable to intentional misconduct or negligence on the part of QPV, provided that the USER has not contributed through fault or negligence.

In any case, QPV shall not be deemed negligent if it demonstrates compliance with all legally required obligations and standards, as well as the diligence reasonably expected according to the nature of the services provided.

Information society services offered through THE WEBSITE that are not subject to prior contracting are provided free of charge. The USER’s only obligation is to comply with the terms of use established in this LEGAL NOTICE.

Accordingly, QPV does not guarantee specific levels of availability of THE WEBSITE or the adoption of particular security measures. Likewise, QPV may suspend, withdraw, or cancel, in whole or in part, any services not subject to prior contracting at any time without prior notice. Such cancellation shall not affect services previously contracted, which shall continue in accordance with the terms agreed with the respective USERS.

Internet access required to use THE WEBSITE is not provided by QPV and remains the responsibility of the USER.

The USER is informed that communications over open networks are not secure. It is the USER’s responsibility to implement appropriate technical measures to reasonably control these risks and prevent damage to their equipment, loss of data, or theft of confidential information. To this end, USERS are advised to maintain updated malware detection systems and keep their browser security settings up to date.

USER OBLIGATIONS

In general, the USER agrees to comply with the terms established in this LEGAL NOTICE. The USER also undertakes to act in accordance with the law, good customs, and the principle of good faith, exercising due diligence appropriate to the nature of the service used.

The USER shall refrain from using THE WEBSITE in any manner that may prevent, damage, or impair its normal operation, or affect the assets or rights of QPV, its suppliers, other users, or any third party.

In particular, the USER agrees to:

  1. If registering, provide accurate information and keep it updated.
  2. Not introduce, store, or distribute through THE WEBSITE any defamatory, offensive, obscene, threatening, xenophobic, violent, discriminatory, immoral, or otherwise unlawful content that infringes public order, fundamental rights, public freedoms, honor, privacy, or image rights of third parties.
  3. Not introduce, store, or distribute software, data, viruses, code, or any electronic or physical device capable of causing damage to THE WEBSITE, its services, QPV systems, users, suppliers, or third parties.
  4. If registered for a service, safeguard their username/email address and password and not allow third-party access to them, assuming responsibility for any damages resulting from improper use. The USER shall promptly notify QPV of any loss, theft, or suspected unauthorized use.
  5. Not carry out advertising, promotional, or commercial activities through THE WEBSITE, nor use information obtained from it for advertising, direct marketing, or any commercial purpose.
  6. Not use false identities or impersonate others, including the use of passwords or credentials belonging to other users.

Communications from QPV to the USER shall be made using the information provided during registration on THE WEBSITE or through the address indicated in the USER’s most recent written communication.

The USER expressly accepts email communications and instant messaging communications (WhatsApp) sent to the mobile number provided, as valid means of communication for matters related to THE WEBSITE and/or the services offered through it.

The USER also accepts notices published directly on THE WEBSITE as a valid means of communication.

INTELLECTUAL PROPERTY, INDUSTRIAL PROPERTY AND IMAGE RIGHTS

All content on THE WEBSITE, including designs, texts, images, photographs, logos, source code, product selections, structure, and layout, is protected by intellectual property rights owned by the website owner or used under authorization from the respective rights holders.

The total or partial reproduction, public communication, modification, transformation, copying, distribution, or any other form of exploitation or manipulation of such content is strictly prohibited.

No USER may carry out such actions without the prior written authorization of QPV and, where applicable, the corresponding rights holders.

Likewise, all photographs displayed on THE WEBSITE are protected by the image rights of the individuals appearing therein. QPV has obtained authorization solely for publication on THE WEBSITE. DISCLAIMER OF LIABILITY

QPV shall not be liable for damages arising from interruptions, omissions, technical failures, computer viruses, telephone faults, disconnections, delays, overloads of Internet services or telecommunications networks, or any other circumstances beyond its control.

QPV shall also not be liable for damages caused by third parties through unlawful interference beyond QPV’s control.

APPLICABLE LAW

Any relationship established between QPV and the USER through THE WEBSITE shall be governed by Spanish law, without giving effect to any conflict-of-law provisions that would require or permit the application of the laws of another jurisdiction.
